Personal injury claims - real case studies - car accident whiplash
backPersonal injury case studiesThis section discusses a typical car accident whiplash compensation claim.
Car accident whiplash injury compensation
The claimants vehicle was hit by another car pulling out of a side road. There was a heavy frontal collision.
The claimant was shocked, distressed and had a neck twinge but was able to compose herself and deal with the aftermath of the accident. The police were called but as happens so often with less serious accidents, they did not attend the scene.
On returning home the neck pain had worsened so the claimant visited the local hospital A&E department. A diagnosis of whiplash was made and she was prescribed pain killers and told to go home and rest. The neck pain increased as the days passed and she was unable to work. This prompted her to call The Claims Connection - the claimant did not have legal cover and was concerned that this precluded her from claiming for her whiplash injury.
We are able to help people claim compensation regardless of legal cover being in place. After a quick conversation with our helpline staff we instructed our road accident specialist lawyers to deal with her claim on a "No win No fee" basis. Within 2 weeks we had taken care of the necessary paperwork and had received an admission of liability from the insurers of the negligent party. The claimants accidental damage excess payable to repair her car - was refunded immediately along with 3 weeks loss of use at £180. Our solicitors then turned their attention to the injury claim.
The claimant needed a course of physiotherapy to help her whiplash symptoms which we arranged free of charge with the cooperation of the insurers. After 4 months the claimant was progressing so well that we arranged to have her examined by an orthopaedic doctor - the doctor reported back to both the solicitor and the insurers on the claimants condition and her likely recovery period. The cost of this evidence was paid in full by the insurers.
The doctors findings were that the claimant would recover from her injuries fully within 2 years. This evidence was discussed by the solicitors and the insurers and a final award of £3500 was agreed in settlement. Seven months after the accident the claimant received her pain and suffering award along with payments for treatment / medication bills and general inconvenience. She had also received the benefit of cost free physiotherapy and was progressing towards a full and satisfactory recovery from her whiplash injuries.
All legal costs were paid by the insurers of the responsible party
Summary - This case emphasises what benefits are to be derived from making a whiplash compensation claim. It is not just about receiving the final settlement - we can also assist you in making a recovery from your symptoms and that is unquestionably the most important aspect of all.
Claims of this nature - with or without legal cover will not cost you one penny in England and Wales. "No win No fee" means exactly that. We also promote the same legal scheme in Scotland but there may be some constraints due to the differing legal system and depending on your circumstances.
