A Compromise agreement is a formal legal document used when an employment contract is being terminated with the agreement and consent of both the employer and employee.

Usually Compromise agreements involve a payment or severance package to facilitate the process and the costs of the process are borne by the employer.

Why choose a Compromise Agreement?

The agreement provides protection for an employer's business because it prevents future claims in respect of the employee's statutory employment rights.

The employee gains the satisfaction of a swift and amicable conclusion to the dispute without the need for a Tribunal hearing.

It is usually the case that an employer drafts the Compromise Agreement for the employee to sign. However this is done on the proviso that the employee obtains a formal legal opinion from a solicitor on the wording and efficacy of the document.

An employee cannot deal with this process on their own. However the employer will (in most circumstances) fund the legal advice required to enable an employee's chosen solicitor to manage the signing of the document.
