Court report - Caselaw discussion

Here we discuss a number of personal injury claims that have actually proceeded to court and where a judge has made an award to the claimant

Case 1 - Brain Injuries - The claimant, a 48-year-old woman, received £475,000 for the severe brain injuries she sustained in a road traffic accident in 1998. The claimant suffered from significant cognitive and behavioural difficulties, impaired sense of smell and taste, a complete loss of hearing in her right ear, mild loss of hearing in her left ear and moderate tinnitus. Future care was required. Out of Court Settlement 25/4/2003 

Case 2 - Tetraplegia - The claimant, a 7-year-old boy, received £1,650,000 for the severe cerebral palsy with tetraplegia sustained in a road traffic accident whilst in utero in August 1995. He had impaired gross and fine motor skills and no voluntary movement or mobility, had profound learning difficulties and also epilepsy and blindness. High Court.18/2/2003

Case 3 - Whiplash injury -The claimant, a 51-year-old woman, received £358,389 for the severe whiplash and back injuries sustained in three road traffic accidents between February and October 1998. She was forced to give up her position as deputy head teacher and suffered from headaches, dizziness and chronic pain. 

Case 6 - Fatal accident - The claimant, a 45-year-old man, was awarded £446,084 for the loss of dependency suffered as a result of his wife's death in a road traffic accident on 1 December 1991. The claimant suffered from MS and his wife had cared care for him prior to the accident. He was forced to move into a nursing home as a result of her death. 

Case 7 - Slip & trip claim - The claimant, a 32-year-old man, received £1,625 following a trip over a hole in a pavement in September 2000. The claimant sustained a swollen and bruised ankle and was unable to drive for two weeks after the accident. Uxbridge County Court 25/11/2002 

Case 9 - Severe hand injury - The plaintiff, a 41-year-old woman, was awarded £200,903 for the severe hand injury she sustained after the helicopter in which she had been travelling crash landed. The plaintiff fractured eight bones in her right hand and required surgery to correct the injury. She had effectively lost all function in her hand and had retired from her job as a typist. High Court 12/2/99

 

Case 10 - Trip injury claim - Damages of £13,500 awarded to interior designer for ankle injury following a trip on a rut in the pavement. High Court16/3/83 

Case 11 - Back injury at work - The Claimant was awarded £86,135.96 total damages for a spinal injury suffered after a fall at the defendant employer's factory. Court of Appeal 18/6/1998 

Case 12 - Injured in fall - Damages of £62,500 awarded to man for back injury following slip in a badly lit area. High Court 20/2/84
