It is illegal to discriminate against someone on the grounds of their sex, race, disability, or trade union membership or non-membership.

RACIAL DISCRIMINATION AT WORK

In order to pursue a case under the provisions of the Race Relations Act, you need to establish that a persons actions (ie: your employer or a colleague) resulted in you getting less favourable treatment than somebody else of a different race. The "actions" taken may have had an effect on your working status and whether that was the intention or not you may be able to claim that you were discriminated against.

There are 3 types of racial discrimination:

Direct discrimination – if you are treated less favourably because of your race than other people who are in the same situation as you, this is direct discrimination. If you are abused or harassed, this is also a form of "direct" discrimination.

Indirect discrimination – can result from for example rules that you are unable to abide by because of your race or religion. If a workplace forbids employees to wear headgear, for instance, then that would exclude many people who were Muslims or Sikhs and this would classify as indirect discrimination.

Victimisation – The Race Relations Act identifies this as  a situation where you have been treated less favourably because you have supported a complaint of discrimination or have made such a complaint yourself and then suffered the consequences.
