Will I have to go to court
to pursue my compensation claim?
Will you actually have to go to court in order to gain adequate
compensation?
This is a very important question.

Generally speaking we
cannot say with 100% certainty that your compensation claim will not
go to trial. There are various estimates and statistics that suggest
the risk of going all the way to the courtroom is very slim indeed.
In our own experience it is less than 2% of cases.
This is not by design
but purely as a result of the way the system operates. Many personal
injury claims dont get anywhere near a courtroom because there are
simple issues to debate and damages are straightforward.
But there are also
personal injury claims that are less than straightforward where both
sides argue over correct damages or very often liability.
Regardless of the
issues, it is very rare to see a case going to trial. But again we
cannot say it doesnt happen because it does and frankly if your best
interests are served in proceeding to trial then that is what we
would recommend you do.
Put it into
perspective, the benefits of making an accident compensation claim
far outweigh the negatives and the vast majority of personal injury claims are
settled out of court.
